Grant of a
Premises Licence

You will need to apply to your Local Authority for the Grant of a new premises licence to authorise one or more of the the above licensable activities.

​

At Silver Fox we will discuss your needs and identify the potential risk factors, and then on receiving your instructions we will draft and submit your application and deal with the required public notices. During the statutory consultation period we will deal with any representations received.

The main advantage of instructing Silver Fox Consultants is that we can guide you through the conditions the Officers from the local authority would expect to see in your application within the operating schedule that is commensurate with the style of your proposed business and trading hours. A modest restaurant operation has less risks involved in respect of crime and disorder than say, a 1500 capacity night club open until 4am in the morning.

 

A carefully crafted application for the grant of a new premises licence will address the concerns the the Responsible Authorities may have and greatly improve the chance of success. As an operator you do not want to have onerous conditions placed on your licence that may prove costly, for example a requirement to have door supervisors on duty on a Thursday, Friday and Saturday from 7pm each night when your business is a simple pizzeria.

As a leading licensing consultancy we have witnessed some extraordinary requests for onerous conditions from Officers that were totally unacceptable and were rejected.

​

Nonetheless, it is not unreasonable to have conditions relating to CCTV and staff training in respect of the prevention of the sale or supply of age restricted goods to young persons under the legal age to purchase or consume those goods.

 

It is worth noting that a breach of a condition of your premises licence could lead to an unlimited fine (used to be £20,000) and/or six months imprisonment so you need to be wary of conditions.

Once the premises licence is granted we will supply you with a bespoke licensing file with all the notices and guidance notes that you will need to be fully compliant with the requirements of the Licensing Act 2003.

Variation of an existing
Premises Licence

VARIATION

If you already have an existing premises licence but now wish to extend your hours or add other licensable activities Silver Fox can guide you through the process, highlight the risk factors and options open to you, and draft and submit the application on your behalf.

There is often merit to meet with officers from the responsible authorities with a pre-application meeting to discuss you aspirations and the direction that you wish to take your business. This provides an opportunity for all stakeholders to have some input and provide insight in to what the concerns might be prior to the submission of the application.

 

Dependent on your circumstances and the merits of your proposed application we can guide you with the options of applying for the grant of a new licence as opposed to a full variation of your existing premises licence.

Licensing Hearings and a
Review of a Premises Licence

LICENSING HEARINGS 

Should an application attract a representation(s) or objections during the consultation period and consensus cannot be reached between the parties and the applicant then the matter will be heard before the Licensing Sub Committee for a decision.​ Hearings take place in the Civic centre and are conducted in a similar style to a case being held in the Magistrates Court.

REVIEW OF A PREMISES LICENCE

If your premises licence has been taken to review by a Responsible Authority, i.e. by the Police, Environmental Protection, Immigration Enforcement or other parties, it is a serious situation that could lead to the revocation of your licence, reduced hours and/or onerous conditions being imposed.
